Proactive Disclosure under Section 4 (1) (b):

 

INTRODUCTION

 

                        The purpose of Suo Motu disclosure under Section 4 is to place possibly a large amount of information in the public domain based on proactive disclosure in order to effectively provide transparency from Public Authorities and to reduce the cost of manpower in filing the individual application under RTI. As such, Section 4 (1) (b) emphasized information which should be disclosed by Public Authorities on a Suo Motu basis.

 

                        Education & Human Resource Department (M/S), Lai Autonomous District Council has come up with is Suo Motu disclosure under RTI Act 2005 in this booklet, to enable the public to have access to the working of the department.

 

(1). The particulars of organisation, functions and duties [Section 4 (1) (b)]:

The Education & Human Resource Department (M/S), Lai Autonomous District Council, Lawngtlai, Lawngtlai District, Mizoram, 796891. Details available in the public domain @ http://ladc.mizoram.gov.in.

 

                        The Education & Human Resources Department (M/S) administers and regulates schools through its rules and instructions issued by the department. The Department is entrusted with the overall administration and control including transfer and posting of teachers, repair and maintenance of school buildings, provision of school facilities, appointment of teachers, maintenance of service books of teaching and non-teaching Middle School Staff, policy formulation, granting of permission for opening and establishment of schools.

 

                        The Department has three separate Wings under its control, viz, the Adult Education Wing, the Hindi Wing and the Laica Wing. The department functions under the leadership of the Executive Member in-charge of Education & Human Resource (M/S) and headed by the Elementary Education Officer (M/S), assisted by one Deputy Elementary Education Officer (M/S), one Superintendent, two Circle Education Officers (M/S), one Assistant Accounts Officer and one Junior Engineer. The Adult Education Wing is headed by the District Council Adult Education Officer, the Hindi Wing under the charge of Hindi Education Officer and the Laica Wing under the Laica Propagation Officer. These Wings function under the control and guidance of the Elementary Education Officer (M/S).

 

Education & Human Resources Department (MS) is entrusted with the following subjects:

 

 

 

 

 

Citizen’s Charter:

 

  1. General/Office Administration.
  2. Repair and maintenance of school buildings.
  3. Conduct of School Games & Sports
  4. Orientation Training for teachers.
  5. School stationary and sports goods.
  6. School Inspection and monitoring.
  7. Matters relating to recruitment/appointment/promotion/transfer & posting/leave of all teaching and non-teaching staff of Middle School under Lai Autonomous District Council.
  8. All service matters relating to teaching and non-teaching staff of middle schools under Lai Autonomous District Council.
  9. Maintenance of personal/service books/ incumbency register of all teaching and non-teaching staff of Middle Schools under Lai Autonomous District Council.

 

Vision/Mission and key objective:

 

            To protect and promote the right of every child to quality, equitable, culture-based and complete basic education, where students learn in a child friendly and motivating environment.

 

(2). The powers and duties of its officers and employees [Section 4 (l) b(ii)]:

 

The powers, functions and duties of officers and employees under Education & Human Resource Department (M/S) are:

 

  1. Elementary Education Officer (M/S):

 

The Elementary Education Officer (M/S) is the official head of the department. He/She is responsible for the observance of business rules and implementing administrative policies within his department. He/She is responsible for all matters, control and supervision pertaining to his department. He/She is the Accounting Authority of the department and is the District Appellate Authority (DAA) (RTI) of the Department.

 

  1. District Council Adult Education Officer:

 

The District Council Adult Education Officer is the head of the Adult Education Wing. He/She is responsible for the disposal of business dealt under his/her charge. He/She should ordinarily be able to dispose of the cases as per the power delegated to him/her.

 

  1. Deputy Elementary Education Officer (M/S):

 

The Deputy Elementary Education Officer (M/S) assists the Elementary Education Officer (M/S) and takes charge of the normal routine works when required and necessary. He/She is the SPIO (RTI) of the department.

 

  1. Superintendent:

 

The Superintendent of the department has overall responsibility for supervising the activities and performance of the office clerks, distribution of works among the staff, timely submission of reports and return to higher officers and other concerned units and maintaining discipline and team spirit in the section.

 

 

  1. Hindi Education Officer:

 

The Hindi Education Officer is in charge of the Hindi Wing. He/She is responsible for promoting and propagating the language in education. He/She is responsible for all matters relating to Hindi Education.

 

  1. Circle Education Officer:

 

The Circle Education Officers supervise and monitor the schools. They have regular field inspections for the proper administration, function and maintenance of the school.

 

  1. Assistant Account Officer:

 

The Assistant Account Officer is responsible for all financial matters within the department.

 

  1. Laica Propagation Officer:

 

The Laica Propagation Officer is in charge of the Laica Wing. He/She is responsible for propagating and promoting Lai language in education. He/She is responsible for all matters relating to Laica education.

 

  1. Junior Engineer:

 

The Junior Engineer is responsible for all the technical matters in the department.

 

  1. Daily Clerk (UDC’s and LDC’s):

 

He/She works as Dealing Officer under the supervision of the Superintendent. Each dealing officer is allocated subjects out of the subject areas allocated to the department and he/she is expected to deal with all matters allocated to any other work assigned to him/her from time to time. Provides miscellaneous support to the Section/Desk in carrying out day to day work like photocopying/ record handling and maintenance, registration of dak, marking, sending receipts/ files and other associated tasks on any other work assigned from time to time. He/She maybe assigned case work of repetitive nature.

 

  1. Multi – Tasking Staff (MTS) (Group ‘D’ post):

 

List of duties of MTS are:

 

  1. Physical maintenance of records of section
  2. General cleanliness & upkeep of the Section/Unit.
  3. Carrying of files & other papers within the building.
  4. Photocopying, sending of FAX etc.
  5. Other non-clerical work in the Section/Unit
  6. Assisting in routine office work like diary, dispatch etc. Including on computer
  7. Delivering of Dak (inside & outside the building)
  8. Watch & ward duties.
  9. Opening & closing of rooms.
  10. Cleaning of rooms.
  11. Dusting of furniture etc.
  12. Work related to his ITI qualification, if exists.
  13. Driving of vehicle, if in possession of valid driving license.
  14. Upkeep of park, lawns, potted plants etc.
  15. Any other work assigned by superior authority.

 

(3). The procedure followed in the decision making process, including channels os supervision and accountability [Section 4(i0 b(iii)]:-

 

The Department follows the procedure indicated in Manual of Office Procedure (MOP) for decision – making. The Superintendent proposed Action with the help of staff (Assistant, UDC and LDC) posted in his section in accordance with the departmental instructions prescribing the level of final disposal and channel of submission for each category of cases. The Superintendent normally submits the file to the Dy. Elementary Education Officer (M/S) who in turn submits the file to the Elementary Education Officer (M/S) and further submit it to the Executive Secretary/Executive Member/Chief Executive Member. Level of submission depends on the delegation of power in the administrative and financial issues. Each officer in the channel is accountable with respect to submission of true facts, but the ultimate accountability lies with the highest level approving a proposal or taking decision.

(4). The norms set by it for the discharge of its functions.[Section 4 (1)(b)(iv)]:-

 

            i) Nature of functions/services offered:-  The Education and Human Resource Department (M/S) is the most important regulatory department of every school that falls under its control within Lai Autonomous District area. On one hand the department prescribes rules and procurement to be adopted in personnel matters specially issues concerning recruitment, training, career development, teachers welfare/Association, whereas on the other hand on the other hand it acts as the controlling department of all teachers and staff relating to disciplinary action under Lai Autonomous District Council area.

                                    The Education and Human Resource Department looks after various important subjects as entrusted to it by “The LADC (Allocation of Business) Rules, 2013”. The Department functions under the leadership of the Executive Member i/c. (M/S). The department is headed by the Elementary Education Officer (M/S), ably assisted by one Deputy Elementary Education (M/S), one Superintendent, two Circle Education Officers and a number of supporting staff in the General Department. He/She is also assisted by one District Adult Education Officer in the Adult Education, one Hindi Education Officer in the Hindi Wing and one Assistant Laica Propagation Officer in the Laica Wing with all their staff in each wing. The Elementary Education Officer (M/S) looks after all the administration within the department and all the Middle School under its Jurisdiction within Lai Autonomous District Council area.

 

            ii) Norms/standards for functions/services delivery:- As per the Manuals, the Department follows the norms set out for all Government of Mizoram offices by the Department of Personnel & Training/Department of Administration Reform and Public Grievances.

 

            i) Process by which these services can be accessed: As per Manual

            iv) Time-limit for achieving the targets: Generally depends on the nature of Works.

            v)   Process of redress of grievances: As per rules.

 

(5). The rules, regulations, instruction, manuals and records, held by it under its control or used by its employees for discharging its Section [4(1)b(v)] :-

            The rules and regulation, instructions and manual etc. Are as prescribed and published by the Ministry of Personnel, Pension and Public Grievances of the State Government and the central Government as well as including AR Wing like FR/SR and other service/establishment manuals and instructions and financial rules like GFR and Delegation of Financial Power Rules issued by Department of Expenditure from time to time.

  10. Files pertaining to up gradation under ACP/MACP and promotion of all Middle school teachers.
  11. Files pertaining RTI and other miscellaneous matters.

Documents were held under departmental Record room supervised by the Superintendent.

            Functioning of Education and Human Resource (M/S) does not involved in formulation of policy relating to various issues. Therefore no such arrangement is required.
